There are no set rules for situations involving fewer than 20 redundancies, and each redundancy scenario will be different for every business, so this may lead to differences in the procedure. However, the guidance given by ACAS in handling redundancies is a key reference point for employment tribunals when considering claims for unfair dismissal.
We can assist you in working through those provisions, giving you a step-by-step process that includes other practical considerations, relevant to your business, to help you through this complex and challenging situation.
In the event that you are proposing to make 20 or more positions redundant at a location within 90 days you must consult with a recognised trade union or (if there isn’t one) elected employee representatives. This is known as collective consultation and there are set rules you must follow, including ensuring that certain information is disclosed to them and when that has to be provided.
